Terms of Use

1. Definitions

Cast Talents, Company, we, us or our means Cast Talents LLC.

User means a visitor, registered Talent, Client or other authorised user of the Website.

Talent includes models, actors, presenters, emcees, dancers, entertainers, performers and other creative or professional talent registered through Cast Talents.

Client means a company, agency, production house, brand, organisation or authorised person seeking Talent or related services.

Booking means a confirmed professional assignment, project, shoot, event or engagement.

2. Our Service

Cast Talents operates a professional casting, talent and related services platform. Depending on the project, Cast Talents may act as a casting agency, talent intermediary, booking coordinator, production-service provider or platform operator.

Nothing on the Website guarantees employment, selection, audition, income or any minimum number of Bookings.

3. Registration & Accounts

Users must provide accurate, current and complete information and keep their login credentials secure.

Users must not impersonate another person, create fraudulent accounts, submit deliberately misleading information or access another person's account without authority.

Cast Talents may request reasonable verification of identity, age, guardianship, company status or professional information.

4. Minor Talents

A person under 18 may participate where appropriately authorised by a parent or legal guardian. The adult creating or managing the profile represents that they have lawful authority to act for the minor and to provide the relevant information and media.

5. Talent Responsibilities

Talents are expected to:

• Maintain accurate and reasonably current profile information.
• Submit genuine and recent portfolio material.
• Apply only where genuinely available and interested.
• Honour confirmed Bookings and agreed call times.
• Behave professionally and respectfully.
• Follow reasonable production and safety instructions.
• Maintain legally required visa, permit, licence, NOC or work authorisation.
• Respect confidentiality and project embargoes.
• Immediately report material changes affecting a confirmed Booking.

6. Client Responsibilities

Clients must provide materially accurate project information, including where applicable:

• Project and role requirements.
• Dates, call times and location.
• Working hours and approved compensation or budget.
• Usage rights, territory and duration.
• Exclusivity requirements.
• Other material conditions affecting the Booking.

Clients are responsible for maintaining a safe, lawful and professional working environment and complying with requirements applicable to their production or project.

7. Casting Applications & Shortlists

Cast Talents may circulate opportunities to relevant members of its database. Interested and available Talents may apply and Cast Talents may review those applications before providing selected profiles to the Client.

8. Bookings & Agency Introductions

Where Cast Talents introduces, shortlists or books a Talent for a Client, communications concerning fees, timing, overtime, usage, cancellation and material Booking changes should be handled through Cast Talents unless otherwise authorised in writing.

Talent and Client must not intentionally use an introduction made through Cast Talents to circumvent the agency in relation to an engagement arising from that introduction.

Accepted quotations, booking confirmations, purchase orders, invoices or signed project agreements may contain additional project-specific conditions.

9. User Content & Intellectual Property

Users retain ownership of content they are legally entitled to own and confirm that they possess all permissions necessary to provide it.

Talent Content may be hosted, reproduced, resized, optimised, displayed and communicated by Cast Talents for platform operation, casting, Client presentation and reasonable promotional purposes.

Except for User Content and third-party material, Cast Talents' Website, branding, database, design, software, text and original materials are owned by or licensed to Cast Talents.

10. Prohibited Use

• Fraud, impersonation, harassment or unlawful discrimination.
• Uploading unlawful, infringing or malicious material.
• Unauthorised system or account access.
• Scraping or harvesting Talent data without permission.
• Spam, phishing or unauthorised solicitation.
• Copying or commercially exploiting the Cast Talents database.
• Misrepresenting a casting opportunity or Client identity.
• Using Talent information for unrelated purposes.
• Any unlawful use of the Website or services.

11. Fees, Payments & Booking Terms

Fees applicable to memberships, subscriptions or services will be communicated before purchase or confirmation.

Talent and Client Booking payments are governed by the applicable quotation, Booking confirmation, invoice, purchase order and/or agreed project conditions.

12. Commercial Usage Rights

Where a Talent's image, voice, likeness or performance is commissioned for commercial use, authorised usage should be defined by the applicable Booking or quotation, including where relevant the medium, territory, duration and exclusivity.

Extensions, renewals, additional territories, additional media or materially different uses may require prior approval and additional fees.

13. Cancellation, Changes & Overtime

Booking cancellations, rescheduling, overtime and material project changes may result in additional charges under the applicable Booking terms and Cast Talents Refund & Cancellation Policy.

Working time may be calculated from the confirmed call time. Overtime must be authorised through Cast Talents.

14. No Guarantee of Work

Registration, profile approval, membership, verification, application, shortlisting or previous Bookings do not guarantee future work.

15. Third-Party Services & Platform Availability

The Website may use independent payment, communications, hosting, analytics or other third-party services. We aim to maintain reliable availability but cannot guarantee uninterrupted or error-free access.

16. Suspension & Termination

Cast Talents may reasonably restrict, suspend or terminate an account for:

• Material breach of these Terms.
• Fraud or suspected fraud.
• Abuse, harassment or repeated Booking misconduct.
• False or materially misleading information.
• Security concerns or unauthorised platform use.
• Non-payment where payment is due.
• Applicable legal requirements.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Cast Talents will not be responsible for indirect, incidental, consequential or special losses arising from use of the Website or conduct of independent Users or third parties.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

18. Indemnity

To the extent permitted by law, a User is responsible for claims, losses or reasonable costs arising from that User's unlawful conduct, material breach of these Terms, infringement of third-party rights or content supplied without necessary authority.

19. Force Majeure

Cast Talents will not be responsible for failure or delay caused by circumstances reasonably beyond its control, including major infrastructure failures, natural disasters, governmental restrictions, war, civil disturbance or widespread telecommunications disruption.

20. Changes to These Terms

We may revise these Terms where reasonably necessary. The latest version will be published with an updated revision date.

21. Governing Law

These Terms are governed by applicable laws of the United Arab Emirates. Mandatory rights or jurisdictional requirements imposed by applicable law remain unaffected.
